1. Sponsor

The AQUA GUARD “Valentine Hair Rescue Sweepstakes” (the “Sweepstakes”) is sponsored by Underwater Audio, LLC d/b/a AQUA GUARD (the “Sponsor”), with a principal place of business at Underwater Audio 215 SW 4th St. Suite 210 Corvallis, OR 97333.

2. Eligibility

The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older at the time of entry. Employees, officers, and directors of the Sponsor, its affiliates, subsidiaries, advertising and promotion agencies, and their immediate family members (spouse, parents, siblings, and children) and/or those living in the same household are not eligible to participate. The Sweepstakes is void where prohibited or restricted by law.

3. Agreement to Official Rules

Participation in the Sweepstakes constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Sponsor, which are final and binding in all matters related to the Sweepstakes. Winning a prize is contingent upon fulfilling all requirements set forth herein.

4. Sweepstakes Period

The Sweepstakes begins on February 6 at 12:00 a.m. PST and ends February 14 at 11:59 p.m. PST (the “Sweepstakes Period”). Sponsor’s computer is the official time-keeping device for the Sweepstakes.

5. How to Enter

During the Sweepstakes Period, eligible individuals may enter by completing the online entry form available at https://manage.kmail-lists.com/subscriptions/subscribe?a=YjVkrx&g=SNqjea (the “Website”) and submitting all required information, including a valid email address, and agreeing to these Official Rules.

Limit one (1) entry per person and per email address for the entire Sweepstakes Period.
Automated, bulk or fraudulent entries, or entries submitted by or through third parties, sweepstakes clubs, or entry services are prohibited and will be disqualified.
Subscribing to marketing emails from Sponsor is optional and is not required to enter or win. If the entry form offers an email marketing opt-in, checking that box is voluntary and will not affect your chances of winning.

Any attempt by an entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, or any other methods will void that entrant’s entries and that entrant may be disqualified.

6. Prize

One (1) Grand Prize will be awarded:

One (1) AQUA GUARD Essential Hair Rescue Kit (contents may include, but are not limited to: Pre-Swim Hair Defense, Gentle Clarifying Shampoo, Everyday Conditioner, After-Swim UV Detangler, Swimplex Hair Mask, and Pre-Swim Skin Defense).

Approximate Retail Value (“ARV”) of the Grand Prize: $119.94.

No cash or other substitution, assignment, or transfer of the prize is permitted, except by Sponsor, who reserves the right to substitute a prize or any prize component with another prize of equal or greater value if the advertised prize is not available, as determined in Sponsor’s sole discretion. Winner is responsible for all federal, state, and local taxes and any other costs and expenses associated with prize acceptance and use not explicitly stated herein.

7. Odds of Winning

The odds of winning the prize depend on the number of eligible entries received during the Sweepstakes Period.

8. Winner Selection

On or about February 15, Sponsor (or its designee) will select one (1) potential Grand Prize winner in a random drawing from among all eligible entries received during the Sweepstakes Period.

9. Winner Notification and Verification

The potential winner will be notified by email at the email address provided at the time of entry within approximately 3 days of the drawing.

If the potential winner (a) cannot be contacted; (b) fails to respond within the required time period; (c) fails to provide any requested documentation within the required time period; (d) is found to be ineligible; or (e) declines the prize, the potential winner forfeits the prize and Sponsor may, in its sole discretion, select an alternate winner from among the remaining eligible entries.

Return of any prize or prize notification as undeliverable may result in disqualification and selection of an alternate winner.

10. Publicity

Except where prohibited by law, participation in the Sweepstakes constitutes winner’s consent for Sponsor and its designees to use winner’s name, city and state of residence, likeness, and/or prize information for promotional purposes in any media, worldwide, without further payment or consideration.

11. General Conditions

Sponsor reserves the right, in its sole discretion, to cancel, suspend, or modify the Sweepstakes or any part of it if fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes, acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner, or otherwise undermining the legitimate operation of the Sweepstakes.

Any attempt by any person to deliberately damage any website or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees) from any such person to the fullest extent permitted by law.

Failure by Sponsor to enforce any term of these Official Rules shall not constitute a waiver of that provision.

12. Release and Limitations of Liability

By participating in the Sweepstakes, entrants agree to release and hold harmless Sponsor, its parent, subsidiaries, affiliates, advertising and promotion agencies, and each of their respective officers, directors, employees, and agents (collectively, the “Released Parties”) from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt, use, or misuse of any prize.

The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any equipment or programming associated with or utilized in the Sweepstakes; (b) technical failures of any kind, including but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Sweepstakes; (d) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; (e) lost, late, incomplete, forged, misdirected, or undeliverable entries, emails, or communications; or (f) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use of any prize.

In no event will Sponsor be liable for attorneys’ fees, punitive, consequential, or incidental damages, or any other damages beyond actual out-of-pocket expenses (i.e., costs associated with entering the Sweepstakes), and all rights to have damages multiplied or increased are hereby waived.

13. Disputes; Governing Law

Except where prohibited, entrants agree that:

Any and all disputes, claims, and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and
Any such disputes shall be resolved exclusively in the state or federal courts located within Oregon, and entrant consents to the personal jurisdiction of such courts.

All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by and construed in accordance with the laws of the State of Oregon, without giving effect to any choice of law or conflict of law rules.

14. Privacy

Information collected from entrants is subject to Sponsor’s Privacy Policy, available at https://www.aquaguardswim.com/pages/privacy. By entering the Sweepstakes, you acknowledge that you have read and agree to the Privacy Policy.
